The rules around smoking in public places have changed a lot over the years, and with not just with indoor space but the outdoors, too. This blog post will compare the smoking bans in four of the world’s biggest nations, no smoking signs specific to the UK to downward trends in North America.
The United States has no single federal law banning smoking in public places. Regulation is shared between federal, state and local governments, producing a patchwork of rules that varies significantly from one state to another. Federally, smoking is banned in government workplaces and on commercial aircrafts, but the key decisions about restaurants and other indoor environments are left to individual states.
As of mid-2024, 28 states and the District of Columbia had passed comprehensive 100% smokefree indoor air laws. By contrast, 12 states (including Alabama, Georgia, Mississippi and Texas) had no general statewide ban in place for workplaces, bars or restaurants.
Interestingly, some cities outpace their own states. For instance, New York City banned smoking in all indoor and outdoor dining areas, including on beaches, in parks and at outdoor plazas, unless they hold a special permit. In Massachusetts, over 22 municipalities had introduced Nicotine Free Generation regulations by early 2026, prohibiting nicotine product sales to people born on or after January 1st 2006, covering more than 600,000 residents combined.
The UK’s indoor smoking ban arrived with the Health Act 2006, making it a criminal offence to smoke in enclosed public places and workplaces across all four nations (England, Scotland, Wales and Northern Ireland). The law completely changed behaviour in pubs, restaurants, transport hubs and offices practically overnight. But, with smoking still causing around 80,000 deaths annually (1 in 4 are cancer-related deaths) and costing the UK economy up to £21.8 billion each year, there is a constant push to go further.
Therefore, in 2026, the UK introduced The Tobacco and Vapes Act 2026, which received Royal Assent in April 2026. Described by the government as the biggest public health intervention in a generation, the Act makes it illegal to sell any tobacco products to people born on or after 1 January 2009, aiming to create a smoke-free generation in which today’s youth will never be permitted to purchase cigarettes. Vaping is now more popular among Gen Z.
For businesses in regulated premises, compliance goes beyond refusing sales: signage is a core legal obligation, with no smoking signs specific to the UK legally required for premises to communicate their smoke-free status under the Health Act. The new Act also grants powers to extend restrictions outdoors, covering children’s playgrounds and areas near schools and hospitals.
Canada regulates tobacco through a shared federal and provincial system. At the federal level, the Tobacco and Vaping Products Act governs the manufacture, sale, packaging and advertising of tobacco and vaping products, while the Non-Smokers’ Health Act bans smoking across all federally regulated workplaces, including government offices, Crown corporations and sectors such as banking and broadcasting.
Day-to-day restrictions, however, are primarily provincial. Smoking is prohibited in enclosed public spaces (i.e. restaurants, bars, shopping centres, offices) across all 10 provinces and three territories. Ontario’s Smoke-Free Ontario Act is perhaps the most comprehensive, extending to patios and a range of other outdoor settings. Many municipalities are also adding on additional bylaws and buffer zones around building entrances too.
Prominent no smoking signs help communicate these rules, which can change from one municipality to the next. Overall, Canada’s current target is a reduction in adult tobacco use to below 5% by 2035, down from approximately 8.4% in 2026.
Australia is consistently seen as a global leader in tobacco control. It was among the first countries in the world to mandate plain packaging on tobacco products – a policy that has since been adopted by several other nations. Smoking is banned under both federal and state law in all enclosed public places, workplaces, airports and on public transport.
A consolidated federal framework took effect in April 2024 under the Public Health (Tobacco and Other Products) Act 2023, maintaining strict plain packaging standards, advertising bans and graphic health warnings.
State laws extend these laws even further, as Western Australia banned smoking within 10 metres of children’s playground equipment and in patrolled beach swimming areas, while New South Wales prohibited smoking in all enclosed public places and a growing list of outdoor settings. Australia now records one of the lowest daily smoking rates in the developed world.
While the largest countries with multiple states have a somewhat more fragmented law system, it’s clear that all four of them are heading in a similar direction, aiming to achieve completely smoke-free generations in the next few decades. This is primarily done through bans of tobacco sales for people born after specified dates, although some other nations, like Canada, are aiming to reduce consumption through other measures.
Despite the slight differences, the public tolerance for smoking is continuously decreasing and public spaces are receiving tighter regulations each year, with no smoking signs becoming a common sight in outdoor areas too.
